Our T&C

Scope

For existing business relationships as well as for all future transactions with Almi GmbH, exclusively the listed terms and conditions apply. These must be acknowledged and form part of every contract. By placing an order, the buyer agrees to these terms and conditions and is irrevocably bound by them. Almi GmbH does not accept any deviating conditions from the customer.
 

Order

Orders received by Almi GmbH before 12 noon will be processed on the same working day. Orders received on weekdays after 12 noon will be processed on the next working day. All orders placed on weekends will be processed on the next working day. Order processing depends on the product and stock availability. Generally, processing and delivery of received orders takes two to three working days. Postal delivery time is not included.
 

Prices

All prices listed on the homepage are quoted in Euros and include the applicable statutory VAT.
 

Conclusion of Contract

Our offers and prices are always non-binding. The contract is concluded upon receipt of the online order from the buyer.
 

Right of Withdrawal

For customers who are consumers within the meaning of the Consumer Protection Act (KSchG), the right of withdrawal applies according to the following provisions:
 

You have the right to withdraw from this contract within 14 (fourteen) days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
 

To exercise your right of withdrawal, you must inform us, Almi GmbH, Hörschinger Straße 1, 4064 Oftering, Tel.: +43 7221 733 99 790, Email: office@naturalpower.at by means of a clear statement (e.g., a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
 

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising from choosing a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal. We will use the same means of payment as you used for the initial transaction unless expressly agreed otherwise; in no case will you incur any fees for such reimbursement.
 

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.
 

You must return or hand over the goods to Almi GmbH, Hörschinger Straße 1, 4064 Oftering, Tel.: +43 7221 733 99 790, Email: office@naturalpower.at without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract.
 

The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct cost of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling the goods beyond what is necessary to check their condition, properties and functioning.
 

No Right of Withdrawal Exists For:

Goods that are unsuitable for return due to their nature, perishable goods or goods whose expiration date has been exceeded;
 

Goods made to customer specifications or clearly tailored to personal needs;
 

Sealed goods which are not suitable for return for reasons of health protection or hygiene and whose seal has been removed after delivery;
 

Goods which have been inseparably mixed with other goods after delivery due to their nature.
 

Delivery Conditions

The sales prices of our products do not include transport and shipping costs. These are charged separately, depend on the country and order value, and can be found in our shipping cost list. Delivery will only take place after all obligations of the buyer (ordering, payment, acceptance of the terms and conditions) have been fulfilled. Shipping takes place within 1-3 working days unless otherwise agreed, to the delivery address provided by the customer. Shipping is done via the Austrian Post AG. Partial deliveries are permitted. No additional shipping costs will be charged. Complaints about partial deliveries do not entitle the buyer to reject further deliveries or the entire order.

Payment Terms

Payment can be made by advance payment, Paypal, Sofort Überweisung, Visa, and MasterCard and is due immediately upon ordering.
 

Acceptance and Payment Default

If the ordered goods are not paid within 10 days after receipt of the order, acceptance or payment default occurs. In case of acceptance default and payment default of the buyer, we are entitled to withdraw from the contract if the contract has not yet been fully performed by both parties. In case of payment default by the buyer, we are released from all further performance and delivery obligations and entitled to withhold outstanding deliveries or services and withdraw from the contract. If the customer withdraws from the contract without authorization or requests a contract cancellation, we may insist on contract fulfillment or agree to the cancellation.
 

Data Protection

Customer data will not be passed on to third parties except when absolutely necessary for contract processing. Data will be used by Almi GmbH for purchase and payment processing. The buyer is obliged to notify us immediately of any changes in data until the contract has been fully performed by both parties. Your order, email and address data will only be stored for internal use.
 

Miscellaneous

Place of performance and jurisdiction is Linz/Austria. Austrian law applies. The agreed Austrian domestic jurisdiction applies. The contract language is German. The contract text (contract components) are stored in our system and sent to the customer by order confirmation. Until full payment, the goods remain the property of the seller; any transfer of the goods during the retention of title is expressly prohibited. The buyer is not entitled to offset claims against the seller; the same applies to the right of retention due to possible claims against the seller.
 

Further Notes

Product names, logos, and manufacturer names are in most cases registered trademarks of the respective owners. Product and packaging images are not to scale. Natural Power is a registered word mark and may only be used against license fees. Copyrights of all page contents belong to Natural Power GmbH, Hörschinger Straße 1, A-4064 Oftering. Any unauthorized reproduction will be legally pursued. Data provided during registration must be complete and correct. If changes occur after registration, the customer is obliged to correct the information immediately.
